Terms of Service

These Terms of Service govern your use of Monitone, operated by Monitone Technologies. By accessing or using Monitone, you agree to be bound by these terms.

1. Acceptance of Terms

By creating an account or using the Monitone platform, you confirm that you are at least 18 years old, have the authority to bind your organisation to these terms, and agree to comply with them.

2. Description of Service

Monitone is an AI-powered brand compliance auditing platform. The service allows marketing teams to:

Upload and manage brand guidelines
Submit content (text, images, documents, video) for compliance auditing against those guidelines
Receive compliance scores, violation reports, and AI-generated rewrites
Manage team members and brand access within their organisation

3. Accounts and Organisations

Each user account belongs to one organisation. You are responsible for maintaining the security of your account credentials. You must notify us immediately at hello@monitone.com if you suspect unauthorised access to your account.

Monitone reserves the right to suspend or terminate accounts that violate these terms.

4. Acceptable Use

You agree not to:

Submit content that is illegal, defamatory, or infringes third-party intellectual property rights
Attempt to reverse-engineer, scrape, or extract data from the platform beyond normal use
Use the platform to audit competitor brand materials without appropriate authorisation
Share account credentials or attempt to circumvent access controls
Submit malicious files or content designed to harm the platform or other users

5. Content You Submit

You retain ownership of all content you submit to Monitone for auditing. By submitting content, you grant Monitone a limited, non-exclusive licence to process that content solely for the purpose of providing the audit service.

We do not claim ownership of your brand guidelines, marketing content, or audit results. We do not use your content to train AI models without your explicit consent.

6. Credits and Payment

Monitone operates on a credit-based model. Credits are consumed when audits are run. Credit costs vary by content type and are displayed before each audit.

Credits are non-refundable once consumed
Unused credits expire as specified in your plan terms
We reserve the right to adjust credit pricing with 30 days notice
Trial credits are provided at our discretion and may be withdrawn at any time

7. Intellectual Property

Monitone, its logo, product name, and all associated software are the intellectual property of Monitone Technologies. Nothing in these terms grants you any right to use our trademarks, trade names, or branding.

8. AI-Generated Output

Audit results, compliance scores, violation reports, and content rewrites are generated by AI and are provided for guidance purposes only. Monitone does not guarantee the accuracy, completeness, or legal compliance of AI-generated outputs. You are solely responsible for decisions made based on audit results.

9. Availability and Uptime

We aim to provide a reliable service but do not guarantee uninterrupted availability. Monitone may be unavailable due to maintenance, upgrades, or circumstances beyond our control. We are not liable for losses arising from service interruptions.

10. Limitation of Liability

To the maximum extent permitted by law, Monitone Technologies is not liable for:

Indirect, incidental, or consequential damages
Loss of revenue, data, or business opportunities
Damages arising from AI-generated audit outputs
Damages exceeding the total credits or fees paid by you in the 3 months preceding the claim

11. Indemnification

You agree to indemnify and hold harmless Monitone Technologies from any claims, damages, or expenses arising from your use of the platform, your submitted content, or your violation of these terms.

12. Termination

You may cancel your account at any time by contacting hello@monitone.com. Upon cancellation, your data will be deleted within 30 days as described in our Privacy Policy.

We may suspend or terminate your access immediately if you breach these terms, without refund of unused credits.

13. Changes to These Terms

We may update these terms from time to time. We will notify account holders of material changes via email at least 14 days before they take effect. Continued use of the service after that date constitutes acceptance.

14. Governing Law

These terms are governed by the laws of India. Any disputes shall be resolved in the courts of Mumbai, India.
